Definitions
‘The Hirer’ The person who places an order with Scunthorpe Wedding Cars for transfer services.
‘we’, ‘us’, ‘our’ Scunthorpe Wedding Cars, Braeburn House, Gashouse Lane, Owston Ferry, DN9 1AL.
'you', 'your' The Hirer, as described above.
‘hire charge’ The total price of hiring a vehicle from Scunthorpe Wedding Cars and the provision of a driver to provide transfer services.
‘deposit’ A non-refundable payment to be paid by the hirer at the time a booking is processed.
Here after the person making the booking shall be known as The Hirer. It will be deemed that The Hirer accepts responsibility for every person in his/her party and fully agrees to the conditions of hire as follows: -
1. QUOTATIONS
Quotations will be in accordance with the details provided and the pricing structure/hire charges in force at the time the enquiry is made. Hire charges upon reservation will be in accordance with the details provided and the pricing structure/hire charges in force at the time the reservation is made regardless of any quotation given prior in response to an enquiry made or any charges shown on our website which have been amended or expired including special offers, Open Day Special Offers and discounted hire charges.
2. DEPOSIT
A non-refundable deposit of £100.00 is required to confirm a booking with Scunthorpe Wedding Cars. The deposit is non-refundable due to costs the business incurs at the point of booking and up to the booked date, these include but are not limited to administration and salary costs. Bookings are not confirmed until the full deposit has been received.
3. RIGHT TO CANCEL (WITHIN 14 DAYS)
A fourteen day cooling off period will commence once you have entered into a contract by means of paying the deposit to Scunthorpe Wedding Cars. During the fourteen days you are entitled to cancel your booking for any reason and receive a full refund. Cancellation after this time will result in forfeiture of the deposit.
4. PAYMENT TERMS
The full outstanding balance of the agreed hire amount is required 28 days prior to the booked date. If the full agreed amount has not been received from The Hirer prior to the booked date Scunthorpe Wedding Cars reserve the right to cancel the booking.
5. CANCELLATIONS (AFTER 14 DAYS)
If The Hirer cancels a booking (for any reason) any time up to 28 days of the booked date and any of the remaining balance has been paid. The hirer will receive a refund for any other amounts paid over and above than the non-refundable deposit. The full outstanding balance is due if a cancellation is received within 28 days of the booked date. Cancellations must be received either in writing in the form of a signed letter or by email from the same email address you have previously provided with your booking details. In this instance we will also contact you by telephone to the telephone number you have previously provided with your booking details. This process is in place to safeguard both parties - The Hirer and Scunthorpe Wedding Cars.
6. REFUNDS
Cancellations where a refund is due will strictly only be paid to The Hirer. Any refund due will be made within 14 days of the cancellation date.
7. CHANGE OF DATE OF HIRE
If the date of hire is changed after the booking has been accepted and a new date has been set the deposit will be carried over to the new date. If Scunthorpe Wedding Cars are not available on the new date the deposit will be forfeited. If the date of hire is to be changed but a new date has not been set, this will be deemed a cancelled booking and the deposit will be forfeited. Refunds will be dealt with according to (5) and (6) above.
8. MECHANICAL BREAKDOWN (PRIOR TO THE BOOKED DATE)
Every care is taken to maintain our vehicles in first class condition but in the unlikely event that the booked vehicle(s) is (are) not available due to accident or breakdown prior to the booked date, Scunthorpe Wedding Cars reserve the right to substitute the vehicle with another vehicle listed on the Scunthorpe Wedding Cars website of a similar condition. If such a substitution is not possible the liability of Scunthorpe Wedding Cars shall be strictly limited to the refund of the hire charge for the specific vehicle, paid under the terms of the booking. Scunthorpe Wedding Cars will not be responsible for any consequential or indirect loss.
9. MECHANICAL BREAKDOWN (ON THE BOOKED DATE)
In the unlikely event of a breakdown on the day that would render the driver unable to continue with the hire, Scunthorpe Wedding Cars reserve the right to substitute the vehicle with another vehicle listed on the Scunthorpe Wedding Cars website of a similar condition. If such a substitution is not possible the liability of Scunthorpe Wedding Cars shall be strictly limited to the refund of the hire charge for the specific vehicle, paid under the terms of the booking. Scunthorpe Wedding Cars will not be responsible for any consequential or indirect loss. As such, we advise The Hirer to have an alternative plan in place as a precautionary measure.
10. DELAYS
Although we will endeavour to meet deadlines, we accept no responsibility for any delays, however caused, for example but not limited to traffic congestion, accidents en route, roadworks. No responsibility can be accepted for adverse weather conditions, for example but not limited to snow, ice, flooding which may cause delay or cancellation of a booking by Scunthorpe Wedding Cars.
11. WEATHER CONDITIONS
In the event of poor weather conditions, for example but not limited to ice and/or snow, it may not be possible to carry out your booking in your chosen vehicle. Scunthorpe Wedding Cars reserves the right to select the most appropriate vehicle on the booked date based on both current and forecast weather conditions. In the event of extreme weather conditions your booking will be cancelled. Scunthorpe Wedding Cars will not be responsible for any consequential or indirect loss. As such, we advise The Hirer to have an alternative plan in place as a precautionary measure.
12. PASSENGERS
The Hirer is responsible for the conduct of all passengers. The Driver may terminate the booking if The Hirer or passengers cause excessive delays, are disorderly, or, in the opinion of the Driver, are unfit to travel.
Children travelling in the vehicle(s) must be accompanied by an adult at all times. Our wedding cars are not private hire registered and therefore current child car seat laws must be adhered to at all times. Scunthorpe Wedding Cars do not provide child car seats. Any child car seats must be provided by and fitted by the parents or guardians of the children travelling. The Hirer is responsible for this. Under no circumstances will any child requiring the use of a car seat or booster seat be permitted to travel if a car seat is not provided.
13. CONSUMPTION OF FOOD AND BEVERAGES
Whilst the Hirer or any member of his/her party are permitted to consume food and beverages inside the vehicle(s) this is done so at their own risk when stationary or whilst the vehicle is in motion. Scunthorpe Wedding Cars will not be responsible for any consequential or indirect loss to personal possessions or clothing in the event of spillage of any food or beverage, whether provided by Scunthorpe Wedding Cars or The Hirer.
14. DAMAGE
The Hirer shall be fully responsible and liable for any damage caused to the vehicle(s) (interior or exterior) by The Hirer or any member of his/her party. This includes incitement to any third party which results in damage to the vehicle or its contents. The Hirer agrees to be liable for the total retail cost of the repair. The location of the repairer will be determined by Scunthorpe Wedding Cars. In addition, The Hirer will be liable to pay Scunthorpe Wedding Cars any further incurred losses by way of cancelled bookings.
Scunthorpe Wedding Cars respectfully requests that whilst confetti and the like are allowed, The Hirer will prevent ‘Silly String’ and similar substances from being used on both the interior and exterior of the vehicle.
15. CLEANING
If following the hire the vehicle(s) is (are) in need of interior cleaning over and above fair wear and tear, for example but not limited to the cleaning of spillages of beverages, food stains, vomit, a cleaning charge of £60 shall be levied against The Hirer.
Bookings are accepted only on the understanding that The Hirer understands and accepts the above terms and conditions, and payment of the deposit signifies such acceptance.
